An Internet republication of another IDX Participant’s listing must contain the listing office name, listing number, status and the IDX icon. This CarolinaMLS-approved icon and an explanation that those properties marked with the icon are provided courtesy of CarolinaMLS must appear on the first page where any listing data is displayed. The following disclosure, appearing alongside the CarolinaMLS-approved logo for IDX will satisfy this requirement:
“The data relating to real estate on this website derive in part from the CarolinaMLS Internet Data Exchange program. Brokers make an effort to deliver accurate information, but buyers should independently verify any information on which they will rely in a transaction. All properties are subject to prior sale, change or withdrawal. Neither [name of website owner] nor any listing broker shall be responsible for any typographical errors, misinformation, or misprints, and they shall be held totally harmless from any damages arising from reliance upon this data. This data is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties they may be interested in purchasing. © 2012 CarolinaMLS.”
In addition, this CarolinaMLS-approved icon must appear on a search result producing a detailed display of another IDX Subscriber’s listing in addition to the name of the listing brokerage, and CarolinaMLS’s copyright notice immediately following the property information.
The following logo with letters "IDX" is to be displayed on the detailed displays and alongside the disclaimer at the bottom of the page. The smaller logo without any lettering should only be used for thumbnail displays on the results page.
Map Displays
In the event that an IDX website displays a map showing the locations of listings matching a consumer’s search with icons or “push-pins,” and a site visitor may display a “pop-up” or “balloon” over the icon or push-pin by clicking or holding the mouse over it, the listing office name, listing number, status and the IDX icon need not be displayed in the pop-up or balloon, provided one of the following is true:
(i) the consumer can click on the pop-up or balloon and view a page, including the listing information and the required elements;
or
(ii) there is a display elsewhere on the page on which the map appears that includes the listing information and the required elements for all such listings on the map.
